BetaWap Terms and Conditions
- This agreement is between BetaWap (accessed through www.betawap.com and by sending an SMS containing the word 'FOOTBALL' to 39055, herein referred to as also 'our' or 'we') and the user of our services (herein referred to also as 'you' or 'your').
- Whilst every effort has been made by BetaWap and its sources to ensure the proper performance of every service, BetaWap, its affiliated companies, suppliers, or any of their employees do not guarantee the availability of services, content and information offered. In particular we make no warranty that the Services will meet your requirements, be uninterrupted, complete, timely, and secure or error free. Errors will be billed in full. By using our Services you indemnify and hold us harmless against all or any loss, liability, actions, suites, proceedings, costs, demands and damages of all and every kind (including direct, indirect special or consequential damages) and whether in action based on contract, negligence or any other action, arising out of or in connection with failure or delay in performance of the Services offered or the use of said Services.
- Our services are NON SUBSCRIPTION SERVICES. This means will be billed once for access to the services which will expire in the stipulated time and will not be billed again unless you choose to renew.
- You must be over the age of 16 and have the bill payer's permission to access any of our services. Should you be under the age of 16 and wish to use our services you should consult with your parent/legal guardian who in their sole discretion and consent you shall be allowed to participate in the services we offer. We indemnify ourselves of any responsibility for the material that people under the age of 16 are exposed to and encourage parents and guardians to monitor the use of our services at all times.
- The subscription cost for our services is R15.00 per a month inclusive of vat and is billed by sending an SMS containing the word 'FOOTBALL' to 39055. A month is defined as the date of registration till the end of the corresponding date of the following month (for example, 28 February 2012 to 28 March 2012). All errors will be billed in full according to our/your networks costs, including but not limited to spelling errors, sending the SMS in another language, delivery failure by our/your service providers, sending the SMS to the incorrect number and/or sending more than one SMS from the same number whilst the previous registration is still active.
- WAP & Bearer charges apply. No free minutes or SMS's are eligible for use with our services.
- Actual content may differ slightly form advertised content.
- We cannot guarantee a 100% service uptime.
- Our services are currently only available to users residing in South Africa using MTN, VODACOM or CELL C as their service provider. Although you should have no problem accessing our services globally once registering using the above constraints, we cannot guarantee this will always be the case.
- We will not be held liable for any service failures or network errors or downtimes. In particular we make no warranty that the Services will meet your requirements, be uninterrupted, complete, timely, compatible and secure or error free.
- We reserve the right to contact you regarding promotions. Your contact details and access information will not be revealed to any third party without your prior notice and consent. This does not apply in special circumstances such as when we believe in good faith that the law requires it or for use with statistics, promotions, shopping, BetaWap associates and affiliates, legal and/or advertisements.
- We will only entertain requests for exchanges, returns and/or refunds at our discretion.
- You acknowledge that by using Betawap and accessing our third-party links you may be exposed to content that is of an adult nature or is offensive, indecent or objectionable. Betawap is not responsible for any such content and you must use your own discretion in whether or not you may suffer harm as a result of access to this content.
- You agree that we reserve the right to deny access to our services to any persons/groups of persons for any reason within our discretion including but not limited to misuse of our services, sharing account details with others, abuse of our services and/or selling our services to third parties without the prior consent of BetaWap.
- The importance of security for all personally identifiable information associated with our users is of utmost concern and importance to us. We exercise great care in providing secure transmission of your information from your PC or phone to our servers. Unfortunately, no data transmission can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit to us or from our online products or services, and you do so at your own risk. Once we receive your transmission, we make our best effort to ensure its security on our systems.
- We reserve the right to log any information sent to our services including but not limited to IP addresses, personal or personally identifiable information and/or demographics of users.
